This Tuesday (March 24), starting at 12:45 p.m. (local time), the President of COP15 and Executive Secretary of the Ministry of the Environment and Climate Change, João Paulo Capobianco, will take part in the workshop “The Role of Law and Judges,” which discusses the importance of legislation and legal institutions in the implementation of multilateral environmental agreements, with a focus on the Convention on the Conservation of Migratory Species of Wild Animals (CMS).
Also attending will be the President of the Superior Court of Justice, Herman Benjamin; the Executive Secretary of the Convention on Migratory Species, Amy Fraenkel; and the United Nations Assistant Secretary-General and Deputy Executive Director of the United Nations Environment Programme, Elizabeth Mrema.
As a legally binding United Nations agreement, CMS establishes that States must protect migratory species that live within or pass through their territories. The meeting will focus in particular on the mechanisms set out in Article III of the Convention, which provides for strict protection of endangered species listed in Appendix I, including measures for conservation, habitat restoration, and the removal of barriers to migration.
The workshop will also highlight the central role of the judiciary in the effective enforcement of these rules—whether in criminal, administrative, or civil matters—as well as the importance of integrating international obligations into national and subnational legislation.
